What are Pre and Post Nuptial Agreements?

A Pre-Nuptial Agreement is a formal written contract entered into by engaged couples prior to their marriage or civil partnership which allows them to decide how their finances should be divided in the event that they separate.

A Post-Nuptial Agreement works in a similar way but is entered into after the marriage or civil partnership has already taken place. Such agreements can be entered into at any time.

Whilst the idea of entering into a Pre-Nuptial or Post-Nuptial Agreement may seem far from romantic, they are designed to help make the relationship a success rather than to facilitate its breakdown.

They provide much needed certainty, confidence and security so that both parties know where they stand during the marriage or civil partnership. They also reduce the prospect of costly and acrimonious litigation in the event of a separation.
