What is a Post-Nuptial Agreement?

A Post-Nuptial Agreement (also known as a Post-Nup) is a formal legal contract entered into by a couple who have already married or entered into a civil partnership. Such agreements are similar to Pre-Nuptial Agreements (Pre-Nups) in that they provide clarity on the financial arrangements, both during the marriage or civil partnership and in the event that the relationship breaks down.

The key difference between a Pre-Nup and a Post-Nup is when the contract is formed. A Pre-Nup is entered into before the marriage or civil partnership. Whereas, a Post-Nup is entered into after the parties have already married or entered into a civil partnership.

There is no time limit for entering into a Post-Nup. These can be entered into at any time after the marriage of civil partnership. The same principles apply to Post-Nups as apply to Pre-Nups. Both parties will need to provide full and frank disclosure as to their current financial circumstances before signing the agreement. They will also each need independent legal advice. This will help to maximise the weight attached to the agreement in the event of a divorce or dissolution.
