The property sales process
The first stage of the sale process is to complete both the property information and fittings form as well as the contents forms. If you are selling a leasehold property, an additional leasehold information form will also need to be completed. The property information form consists of 16 questions which include boundary ownership, disputes and building work to the property.
Once all of these forms have been completed and returned, a draft contract pack will be issued to the buyer’s solicitors. There is then usually a bit of a wait while the buyer’s solicitors requests the searches, and, if required, waits for a mortgage offer.
The next step in the process is to raise enquiries. At this stage, we may need to contact you for assistance and help. Once all enquiries have been answered and resolved, and you have signed the contract, we can then progress to exchange of contracts.
Purchasing a property
Once we have received the contract documentation from the seller’s solicitors, and as part of the service, we will carry out all the detailed and required conveyancing searches (Local Authority search, drainage search and an environmental search). Our team will also check that the title to the property is good and marketable, as well as provide you with a full written report on the property you are purchasing.
Our expert property lawyers will prepare all of the necessary contracts, Stamp Duty Land Tax Returns and transfers on your behalf. Once you are completely happy, and all your queries and questions have been answered, we can then progress to the final stage in the process; the exchange of contracts.
Exchanging property contracts
On the day of exchange, we will first get in touch to confirm the details of the contract, including the completion date, and obtain your authority to go ahead with the exchange.
Once we have exchanged, both parties involved will be under contract and neither will be able to withdraw without possible financial loss. We will also confirm to you by telephone and letter once the exchange has taken place.
Completing your purchase or sale
The day has finally arrived, once the money has been transferred between the solicitors and has been received safely, we will confirm to you that completion has taken place, and you can collect the keys to your brand new home.
After completion, we will deal with the payment of Stamp duty, the registration of your title and mortgage at the Land Registry, as well as deal with the redemption of your mortgage if you are selling your property.
