Options for Resolving Family Issues

Our team consists of trained collaborative solicitors, mediators and litigators meaning that we are confident that no matter the situation, we are able to draw on our wealth of experience to resolve matters swiftly, proactively and in the most cost-effective manner.

Discussions Between You

Many couples are able to continue to communicate effectively following separation, either in relation to financial matters or their children. We are able to provide you with the necessary legal advice to structure those discussions and allow you to formalise any agreement reached.

Mediation

Mediation is one of a number of options for resolving disputes over money or children between separating couples, which can avoid the need to go to Court. Find out more about our family mediation service.

Collaborative Law and Round Table Meetings

This process allows each person to appoint their own solicitor in order to arrange joint meetings in order to try to work things out face to face. This ensures that you have support and legal advice throughout the process but also allows you to retain control of the decisions that are being made. All of our Lawyers are trained to deal with round table negotiations. Sean McNally and Deborah Leask are also trained Collaborative Lawyers. For further information in relation to the Collaborative Processes please visit the Resolution website: http://www.resolution.org.uk/collaborative/

Court

Sometimes it is necessary to seek the Court’s assistance in resolving issues over children and finances. This is often necessary where:-

  • One or both parties have unrealistic expectations and this is a block to a negotiated settlement.
  • There is an unresolved factual issue which is of central importance and a Court ruling is required.
  • One party has given a dishonest or misleading financial disclosure.
  • All attempts at resolving the dispute through non-Court options have been exhausted
  • There is a pressing need to resolve matters quickly and a Court imposed timetable is considered the most effective way forward.
