The collaborative process is a distinct method of resolving disputes. It involves both sides in a dispute working together with their solicitors so as to avoid the need for involving the Court. Other professionals who are collaboratively trained can also become involved.

The process differs from the more traditional approach in that it is less formal and involves active participation by clients and their solicitors in meetings where everyone attends with a view to discussing issues openly but in a respectful and dignified way. Not every case is suitable for the collaborative process and we can assess with you whether the collaborative process is right for you.

Participation Agreements

If it is, everyone is required to sign up to a participation agreement which sets out clearly the terms for how we will work together. Importantly, the agreement sets out the guiding principles about the way the collaborative meetings are conducted which include:

  1. It is your choice to work together with the solicitor to find solutions that work.
  2. The meetings are confidential (except for certain conditions that we set out in the Agreement).
  3. The role of the solicitors is to assist you in reaching a solution.
  4. The decisions are yours to make having received advice from your respective solicitors.
