Issues arising from shared ownership of property

We are regularly instructed following the breakdown of same-sex relationships where the parties in question have owned their own home together but have not entered into a civil partnership or marriage.

Unfortunately, such couples do not benefit from the same legal protection as those who have placed their relationship on a more formal footing. In those circumstances, determining ownership of a property is dependent upon complex property and trust law which may take into consideration agreements made during the relationship, contributions from each partner or the intentions of the parties.
