Updates to sentencing of serious motoring offences

In general, sentences for Causing Death by both Careless and Dangerous Driving have been increased along with the Guidelines for Causing Serious Injury by Dangerous Driving. Before this legislation the only offence applicable to serious injury cases was triggered by Dangerous Driving.

What are the updates on sentences?

The new offence of causing serious injury by careless driving has been created with a maximum sentence of two years imprisonment.

Traditionally, sentencing for Careless Driving, which can be committed by a simple moment’s inattention focused solely on the standard of driving, and injuries short of death were not a factor in sentence. Sentences for careless driving previously ranged from 3-9 points of endorsement on a driving licence with a potential disqualification which was discretionary only. Nowadays however, this offence will carry an obligatory disqualification, the potential of a curfew, unpaid work and a prison sentence.
