I have been offered a settlement agreement: what do I need to do?
This article guides employees through what to do after receiving a settlement agreement, stressing the need for independent legal advice, outlining how solicitors can review or negotiate the terms, and explaining how legal fees are usually covered.
You will need to obtain independent legal advice on the settlement agreement. This is a requirement for the settlement agreement to be considered legally binding. The reason being is that a settlement agreement brings employment to an end and will include a number of obligations/ warranties which you will need to seek advice on.
How do I obtain legal advice?
Our Employment Solicitors are experienced in dealing with settlement agreements. We offer appointments via telephone or via Teams/Zoom. A face to face appointment can be arranged if necessary. We can arrange a same day appointment and sign off.
What happens in my first appointment?
During your appointment we would explain the settlement agreement to you, advise you in relation to any amendments and discuss the background/your potential claims that you may be settling. We will endeavour to explain the agreement without as much legal jargon as possible to ensure that you understand the agreement.
There may be scope to negotiate further with your employer to achieve a better deal, in which case, we would discuss this with you. We have a lot of experience in negotiating improved agreements.
If you are happy with the terms of the agreement, we will arrange for the agreement to be signed and will return this to your employer on your behalf. Alternatively, we can negotiate further with your employer until an agreement is reached (if agreed).

Make an enquiryHow much will legal advice on my settlement agreement cost?
Your employer will normally contribute towards your legal fees for obtaining legal advice on the settlement agreement. If you are happy with the settlement offered, we guarantee that we will cap our fees at the contribution offered. This means to have the agreement explained and signed off, you will not pay anything to us.
If you require assistance with negotiations, we will provide you with a fee estimate for this work. It is possible for your additional legal fees to be paid by your employer by asking for an increased contribution as part of the negotiations, a fixed fee, or a no win no fee type agreement. If you are undecided about negotiation, please get in touch for a free discussion.
