What is a Party Wall Act dispute?
A party wall is a building or wall which is shared by two properties. It could be the wall between houses (where the houses are either terraced or semi-detached), the wall of a garage or a wall dividing the gardens.
What is the Party Wall Act?
The Party Wall Act 1996 exists to provide owners of adjoining land with a framework to help prevent or resolve disputes. It also has provisions relating to excavating s close to neighbouring buildings.
A notice of intended works must be given to the neighbouring owner. The neighbour can object to the works or require additional works to be carried out. If the parties cannot agree on what needs to happen then the Act sets out the process to be followed which will result in the making of a Party Wall Award.
