Artificial intelligence (AI) has rapidly become a powerful tool used in all aspects of the law, including in the family law sphere. Applications such as ChatGPT can generate documents, summarise information and assist with administrative tasks in a matter of seconds. Whilst these capabilities offer significant efficiencies, they should not be mistaken for legal expertise.

In family law, where legal issues are deeply intertwined with personal relationships, emotions and the welfare of children, the knowledge, professional judgment and experience of a qualified family lawyer in producing and finalising agreements (such as consent orders and nuptial agreements) is irreplaceable.

The limits of Artificial Intelligence in Family Law

Family law is rarely straightforward. Every case presents a unique combination of legal, financial and emotional factors that require careful analysis and professional judgment. While AI systems can process large amounts of information and generate text and agreements that appear reliable, they do not understand the nuances of individual circumstances.

The weight attached to an agreement which has been entered into without the benefit of legal advice is likely to be greatly reduced (if any weight is attached to it at all).

Family law matters frequently involve highly sensitive personal information, including financial details, health information and issues concerning children. Entering such information into publicly accessible AI platforms can create significant confidentiality and data protection risks.

Legal professionals have strict obligations to protect client confidentiality and comply with data protection legislation, including GDPR requirements.
