Employment Tribunal Fees Unlawful – Reopening of Previous Claims

A case management order was issued on 9th August by the President of the Employment Tribunals

The order states that all cases that are brought following the decision that fees are unlawful should be put on hold (stayed). These cases will be put on hold pending the decisions of the Ministry of Justice and Her Majesty’s Courts and Tribunals service in relation to the decision that fees are unlawful.

The guidance also says that anybody wishing to reopen a claim that was rejected due to non payment of a fee should do so by making application to the Regional Employment Judge in the relevant tribunal region.
