Personal Injury Update – further delay for whiplash rules

The new rules governing the MOJ whiplash portal look set to be further delayed after it was revealed that they were not signed off at this months Civil Procedure Rule Committee (CPRC) meeting. This is likely to mean that law firms and insurers will not have sight of the new rules until May, only 3 months before the portal is due to launch on 1st August 2020.

The planned implementation of the new protocol and practice direction has already been delayed from the original implementation date of 6 April 2020, due to deferred consideration from the CPRC on the rules in February.

Speaking earlier this month, Richard Hutchinson, head of the whiplash reform programme, advised: “We’re hoping to give you three months between finalisation [of the rules] and go-live, and from conversations we’ve had with the ABI and other stakeholders, that was an appropriate amount of time [to get ready].”

However, in a statement issued yesterday by the chief operating officer of the Motor Insurers Bureau (MIB), who are assisting with the build of the new portal for the MoJ, it was made clear that the CPRC did not sign off the new rules at its most recent meeting this month.

While the MOJ has confirmed they will be continuing to work towards the August implementation date it is not clear what impact the Coronavirus pandemic will have on progression or further delay on the reforms. The MIB have confirmed staff are working remotely to continue to support the delivery of the reforms, but there are many obstacles yet to overcome which may cause the reformed to be pushed back further.
