  • I have been arrested and charged with drink driving; what is the minimum ban that I will face?

12 months depending on the amount of alcohol consumed with 3 months dispensation if a driver’s rehabilitation course is passed within the timescale set down by the court

  • I was caught doing 103mph on the motorway. I have a clean driving licence. How many points will be endorsed on my licence or will I be disqualified?

For exceeding the speed limit by 33mph you are likely to be disqualified for up to 56 days (or less with strong mitigation) or your licence endorsed with 6 penalty points

  • I already have 9 points on my licence within the last 3 years and have just been summonsed to court for contravening a red traffic light – will I be disqualified?

Yes, because the red traffic light offence carries 3 penalty points bringing the total within 3 years to 12 penalty points, unless the court are satisfied that exceptional hardship will be caused to the driver or persons closely associated to with the driver and they exercise their discretion not to disqualify for the statutory minimum period of 6 months or to reduce that period of disqualification to say, 3 months.

  • I reversed into a car whilst parking in a supermarket car park. I did get out and inspect the damage but it was minimal. I didn’t leave a note with my name and address nor did I report it to the police. I have now received a call to attend the police station for an interview. What offences am I likely to be charged with?

    • Failing to stop after an accident which means stopping for such time as is reasonable to exchange details with the other driver or any other person who may require your particulars
    • Failing to report an accident to the police as soon as practically possible and in any event within 24 hours
    • Careless driving

If you receive a notice of intended prosecution or commit any road traffic offence and this is likely to be or is being investigated by the police I strongly recommend that you contact me as soon as possible for initial free advice.
