Mental Incapacity (Management of Affairs)

A person can put in place Lasting Powers of Attorney (or previously Enduring Powers of Attorney) to allow people they trust to deal with their affairs if they become unable to do so themselves. Please find out more on our Powers of Attorney page.

However, if there is no Power of Attorney in place and a person loses capacity to make decisions for themselves it can raise practical difficulties as to how that person’s affairs are dealt with. Often what is required is an application to the Court of Protection to appoint someone to manage their affairs.
