My insurers have referred me to a panel Solicitor. Do I have to use them?

The simple answer is no. More and more people these days have legal expenses cover attached to their motor insurance policies. If you contact your insurers, they will usually tell you that you must use a firm of Solicitors appointed by them (“a panel firm”). They will not be a firm of Solicitors local to you. In our experience, the majority of our clients have told us that they prefer to deal with a Solicitor who is local to them so that they can discuss the case face to face with them throughout. Many insurers will instruct Ellis Jones to act under the terms of their legal expenses cover.

What if the other party does not stop or is uninsured?

It is still possible to claim compensation for injuries sustained in a road traffic accident even where the other party cannot be traced or is uninsured. Such claims are handled by a Government funded organisation called the Motor Insurers Bureau (MIB). The MIB will step into the place of the other driver and will pay you as if the other driver was insured.

Claims through the MIB are very complex and special rules apply. Our specialist team has vast experience in dealing with MIB claims and can lead you through this difficult process. If you are involved in such an accident, you must report it to the police as soon as possible or the MIB will refuse to deal with the claim.
