Please note that upon receiving your initial instruction we will require your ID documents.STEP 2 - LETTER BEFORE ACTION
We will then send a initial letter giving the debtor 14 days to pay. This protects your right to claim interest and costs.
STEP 3 - CLAIM
If the debtor pays in full on receipt of the letter of claim you pay us NOTHING in addition to the initial fee.
If the debtor does not pay you are responsible for the additional fixed charges and court fee (see costs)
STEP 4 - JUDGMENT & ENFORCEMENT
If no defence is received nor payment made, we will enter judgment. We will discuss with you the enforcement steps and charges appropriate to your debt.
STEP 5 - DEFENCE
If a defence is filed we can deal with this for you. We will need to discuss the question of costs with you further at this stage.
Am I guaranteed to recover my debt?
We shall try our best, but we do not advise clients to pursue debts where there is a real risk that the money will not be there at the end of the day. There's nothing worse than throwing good money after bad. If in doubt we can (for a modest fee) carry out tracing and credit checks before you decide how to act.
I am owed a substantial sum but I can't find the debtor? Can you help?
We can for a moderate fee help arrange the use of tracing services on a no trace, no fee basis.
If successful you will pay the cost of the trace.
How long will this take?
Many debtors are simply trying to delay payment, not avoid it; and many pay after the first letter. Other cases take longer depending on whether the debt is disputed and whether you need to take enforcement action after judgment. We will discuss likely timescales at the outset of your case.
If I don't get paid immediately, what can I do?
Debt recovery sometimes requires patience. But if you don't recover immediately you can try again later should the debtor's circumstances improve. We can arrange to remind you of this.
I'm reviewing my aged debts. Some of them are quite old now, what can I do?
You have 6 years from when the debt became due to start proceedings to recover most debts. Don't delay; speak to us and we can help you decide what action to take.
