What is an Agreement for Lease?
An Agreement for Lease is a contract between the Landlord and Tenant agreeing to enter into a Lease at some point in the future.
The key points about an Agreement for Lease are:
It binds the Landlord and the Tenant and
The Lease has to be negotiated and agreed at the same time as the Agreement for Lease (see Drafting and Negotiating Leases for further information about Leases)
An Agreement for Lease is usually agreed when the Tenant cannot immediately occupy the Land.
For example:
The Land needs to be developed by the Landlord or
The Lease is dependant on another event such as buying a Business from someone other than the Landlord
