Airbag Injury Claim Success

Head of Personal Injury at Ellis Jones, David McWilliam has just secured damages of over £31,000 for a client that was injured in a car accident. He suffered a whiplash injury and lower back pain after he was hit in the side at a mini roundabout. Two weeks after the accident he informed David that he was suffering from hearing problems and ringing in his right ear which he thought maybe from the side airbag that was deployed in the accident.

After organising a referral to a hearing specialist and undergoing hearing assessments, he was diagnosed with hearing loss and tinnitus in his right ear. A referral was made to an ENT Consultant and funding obtained for all of his treatment from the other party’s insurers.

He was fitted for a hearing aid and purchased a White Noise Generator to help him sleep at night as the ringing in his ears (tinnitus) was affecting his sleep. Although the hearing problems will be permanent, the hearing aid and White Noise Generator have made life somewhat more bearable.

A claim was also made for the future cost of these items that would need replacing for the rest of his life and for the purchase of batteries for the hearing aid.

David also arranged for him to undergo an extensive course of chiropractic treatment privately to help with the neck and back injuries. Again, funding was obtained for this treatment from the insurers.

David’s specialist knowledge of airbag injuries turned this claim from a lower value neck and back injury claim into a higher value claim that has resulted in a much better quality of life for the injured client.
